For a criminal case in Georgia, prosecution for a DUI is handled in a State Magistrate Court, State Court, or Superior Court. The penalties and statutes covering DUI can be found in the Official Code of Georgia Annotated (OCGA).

For the civil case resulting from a DUI, an accused person will face having their driver’s license suspended by the Georgia Department of Driver Services (DDS). A person can challenge the suspension through administrative proceedings conducted by the Office of State Administrative Hearings (OSAH).

There are a lot of great restaurants, bars and breweries in Atlanta, including the local communities of Buckhead, Brookhaven, Chamblee, Tucker, Doraville, Decatur, Lilburn and Lawrenceville. The fact is, many people will drive after drinking with friends at dinner or a party. Just because you consumed alcohol prior to operating a motor vehicle doesn’t mean your guilty of DUI.
